This End User License Agreement ("EULA") is a legal agreement between you and Curio Connection for the Curio Connection mobile application ("App"). By downloading, installing, or using the App, you agree to be bound by this EULA. If you do not agree, do not use the App.
Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to:
• Download, install, and use the App on devices you own or control.
• Use the App for personal, non-commercial purposes in accordance with its intended functionality.
You may not:
• Copy, modify, or create derivative works of the App.
• Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App.
• Rent, lease, lend, sell, sublicense, or otherwise transfer the App or your rights under this EULA.
• Remove or alter any copyright, trademark, or other proprietary notices in the App.
• Use the App for any unlawful purpose or in violation of applicable laws.
• Use the App to harm, harass, or infringe the rights of others.
The App, including all content, features, design, code, and materials (except user-provided and AI-generated reading content), is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. This EULA does not grant you any rights to our trademarks or the App's underlying technology beyond the limited use license described above.
The App may include or use third-party software, services, or content (including AI services such as Groq and Google Firebase for authentication and cloud storage). Your use of the App may be subject to those third parties' terms and policies. We are not responsible for third-party components. The App is for self-reflection and entertainment and does not diagnose, treat, or prevent any medical or health condition.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
• WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR GOODWILL.
• OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THIS EULA OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM (OR $0 IF THE APP IS FREE).
This EULA is effective until terminated. Your rights under this EULA will terminate automatically if you fail to comply with any term. We may terminate this EULA at any time for any reason. Upon termination, you must cease all use of the App and uninstall it. Sections that by their nature should survive (including 3, 5, 6, and 8) will survive termination.
This EULA is governed by the laws of the State of California, United States, without regard to conflict of law principles.
If you acquired the App from the Apple App Store:
• This EULA is between you and us; Apple is not a party to this EULA. Apple has no obligation to provide maintenance or support for the App.
• Apple has no warranty obligation except as required by law.
• Apple is not responsible for claims relating to the App or your use of it.
• If the App fails to conform to any applicable warranty, you may notify Apple for a refund; we have no other obligation.
• Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you.
